Social Security Disability benefits are available if a disability prevents a person from performing substantial gainful employment and if the person has the required work credits to be eligible for social security disability benefits. What are the Fees for Social Security Disability Cases?
The attorneys fees in social security disability cases are regulated by federal law. The law states the attorneys fees are 25% of the claimant’s retroactive benefits or a flat fee (which currently stands at $6,000), whichever is less. These attorneys fees are contingent on the attorney’s ability to successfully get an award of benefits for the claimant. Thus, if there is not award for back benefits, there are no attorneys fees. An attorney is not entitled to receive any monies from a claimant’s monthly checks from Social Security.
Once we are notified that our client has been approved for Social Security Disability benefits and the amount of the back benefits is determined, the Social Security Administration sends the attorney his or her fee check. Although the client does not pay any part of the attorneys fees out of his or her pocket, the client is responsible to reimburse an attorney for his or her expenses (costs). In our office, we do not charge the client costs if we do not prevail on their social security disability claim.
