Summertime Fun: Tips on playing it Safe!

Memorial Day weekend in Florida is at the end of the month; school is almost out, and most colleges are on their way to beginning summer sessions, which means summertime activities will soon be in full swing! Wave runners, jet skis, boats, and water scooters are very popular on our Clearwater and St. Petersburg beaches this time of year. While water sport activities are on the rise with the temperature, so are the related accidents and legal problems that arise from these activities.

It is important to know what Florida law requires when it comes to certain water sport activities; being uninformed of the law will not work in your favor. For example, the state of Florida classifies water crafts to be dangerous instrumentality, and any operator of a these types of water crafts must exercise the highest degree of care when operating these vessels in order to prevent injuring someone else, according to Florida Statutes, sec. 327.32. If you accidentally injure someone while operating a watercraft vessel, you could end up being the person responsible, even if it was loaned or rented to you.

Additionally, Florida Statutes sec. 327.39 states that 1) it is illegal for anyone under the age of 14 to operate a watercraft; 2) you must wear a flotation device (i.e. a life jacket); 3) you must attach the engine cut-off rope to your clothing; and 4) you cannot operate watercraft after sunset or before sunrise.  Failure to obey any of these laws could result in a second degree misdemeanor, which could result in jail time.
