Settlement After Falling Dresser Kills Child
09 Aug 2007
After filing a lawsuit and attending a mediation conference, the law firm of Perenich Caulfield Avril Noyes was able to secure a settlement for a ggrieving family following the death of their young son. The young child died after his dresser toppled over on him after he opened the drawers, crushing him underneath and causing craniocerebral blunt force trauma. The young boy died within hours.
Perenich Caulfield Avril Noyes brought a lawsuit against the seller and the manufacturer of the dresser alleging failure to incorporate available safety measures to prevent "tip over" accidents and failure to warn the buyers of foreseeable risk of "tip over" in their dresser. There was expert testimony that the dresser that killed this little boy was defectively designed and manufactured.
The senseless death of a child is gut-wrenching on the family. No amount of money can ever bring a child back, but bringing such a claim and holding the wrongful party responsible may prevent another family from suffering the same horrors.
